Best agent for service of process services in West Virginia

Facts checked October 13 to 15, 2026.

West Virginia's statute (W. Va. Code § 31B-1-108) lets a domestic corporation, another LLC or a foreign corporation or foreign company authorized to do business in this state serve as the agent, so a commercial service can fill the role. The state's position is that West Virginia LLCs are not required to appoint an agent for service of process, and the agent line on the Articles reads "agent to whom notice of process may be sent, if any." So the first decision is whether to name an agent at all, and only then which service. If you do hire one, the $25 annual report gives compliance features real work here, so compare renewal price, report filing and how easy each service is to leave.1, 2, 3

West Virginia law uses the term agent for service of process. Most states call the same role a registered agent. What the term means in West Virginia

How is the list ordered, and what was compared?

The list runs by our score, highest first, with tied scores placed in editorial order. Our score is built only from published facts with a citation behind each, and how we score shows the method.

We don't test services. Trustpilot ratings are third-party, cited to Trustpilot, and not adjusted.

Below the table, every provider gets one paragraph built from the same short list of published terms: the agent price and its renewal, how papers reach you, any rule on using the agent's address, auto-renewal, how to leave, and refunds. Where a provider's pages are silent on a term, the paragraph says it doesn't publish that term. What the agent does in general is in what an agent for service of process does. This page covers only the choice of a paid agent for a West Virginia LLC.

How do West Virginia's rules change the choice?

West Virginia's rules shape the choice in a few ways: the agent is optional, the formation form has its own line for a physical office, and the annual report carries a small state fee with a fixed window.

An optional agent

West Virginia's statute says an LLC "may" maintain an agent, and lacking one is not a ground for dissolution. An owner can leave the agent line blank, name a person, or hire a service. Who may serve if you do name one is set by statute: an individual resident of this state, a domestic corporation, another limited liability company, or a foreign corporation or foreign company authorized to do business in this state. Where legal papers go when no agent is named isn't covered by the facts we cite, so ask the West Virginia Secretary of State or a lawyer before you leave the line empty. The West Virginia agent for service of process guide covers who may serve and the address rules in depth.1

The designated office is a separate line

The Articles of Organization (Form LLD-1) asks for the address of a designated (physical) office in its own field, apart from the agent. The statute says that office is one which need not be a place of its business in this state. A service named as agent fills the agent line with its own address, as every commercial agent does. Whether a provider's address may also be used as the designated office is not something the providers' published terms answer, so ask before you file.1, 2, 4

A yearly report that services can file

West Virginia LLCs file an annual report between January 1 and June 30 of each year, starting the year after registration, for $25; an LLC can later use the biennial report option after 5 consecutive timely annual reports. Among the details it asks you to update is the agent of process, so a change of service shows up there too. Miss the window and you pay a $50 late fee if received after June 30 (total $75). Several providers sell report filing, at prices well above the state fee, so check each one's figure below.3, 5

The cost of switching

Naming a new agent costs $15 on Form AAO, and the state allows online filing via the One Stop portal. With a fee that small, a provider's notice period or refund rule is usually the larger cost of switching. File the change first, then cancel; how to change an agent for service of process walks through the order.6, 7

How do the services compare for a West Virginia LLC?

Providers follow the table's order. Each paragraph sets out that provider's published terms and notes where one meets a West Virginia rule.

Tailor Brands

Tailor Brands supplied its agent price, $199/year, and its renewal, $199/year (renews at the same price). Papers arrive as documents scanned and uploaded to the business dashboard. Its terms set one limit: "Agent address cannot be used as the business location in public materials." That leaves the separate Virtual Address product for a public business address; Tailor Brands doesn't publish that product's price. On compliance, the provider says the agent can file the annual report if instructed, which in West Virginia means the $25 report due between January 1 and June 30 of each year. Subscriptions run with auto-renewal on by default for subscription services, and fees are non-refundable to the maximum extent permitted by law. The Essential plan ($199/yr plus state fees) folds annual report filing into formation. Full details are in the Tailor Brands review.8, 9, 10, 11, 12

ZenBusiness

ZenBusiness asks $199/year for the agent and renews it at $199/yr, with 50% off the first year ($99) when you form an LLC. You get scans, and originals forwarded only if they can't be copied. For the West Virginia report it sells Annual Report Filing $100 per report or Worry-Free Compliance $199/year, both well above the state's own fee. Cancelling means contacting customer support by phone, and money comes back only if the service has not yet been used. Read the ZenBusiness review.13, 14, 15

LegalZoom

The agent costs $249/year (first-time registered agent customers) at LegalZoom, and the terms add: "Renews at the purchase rate each year; rate subject to change." It lists legal documents scanned and uploaded and email reminders about annual report deadlines via Compliance Calendar. A one-time report filing is $99 + state filing fees, bills once. Its agent terms limit refunds: "prepaid fees for current term refunded only when LegalZoom terminates the service." On the way out, proof of new RA may be required, so file the West Virginia change form first. Read the LegalZoom review.16, 17, 18

Bizee

Bizee's agent costs nothing for the first year with any Bizee formation package, then $149/year (ongoing annual fee); bought alone it is $149/year. Lawsuit papers are mailed via FedEx with tracking. Bizee also sells a business address at $29/month, with a free first month for formation customers. You cancel by assigning a new registered agent with the state and notifying Bizee of the change, so the West Virginia change form goes in before the message to Bizee. Orders are generally refundable until payment is forwarded to a government entity. Read the Bizee review.19, 20, 21, 22, 23

Swyft Filings

Swyft Filings lists the agent at $149 per quarter ($596/year), the largest yearly agent figure here. It posts legal papers to your account typically within 2-3 hours. To leave, a replacement agent must be designated (or business dissolved) before cancellation. Its report product is ComplianceGuard $199/year, offered with a 14-day free trial then auto-charged, so set a reminder if a $25 state report is all you need filed. Read the Swyft Filings review.24, 25, 26

doola

doola's agent page quotes $297 per year without making clear whether that buys the agent alone or a formation plan, and it says the agent is free with Formation Service. It offers same-day scans; paper forwarding is "Not included in base RA subscription unless stated in plan." doola's agent comes with report notifications, but Starter does not include ongoing compliance filings, so filing the West Virginia report falls to you on that plan. doola doesn't publish its state coverage on the pages we checked. Read the doola review.27, 28, 29

Northwest Registered Agent

Northwest charges $125 per year and lists offices in 50 states plus D.C. and Puerto Rico. Its page says "RA customers auto-enrolled in Compliance Services billed in annual auto-pay," and its report service is $100 + state fees, charged at filing. In West Virginia that service would sit on top of a $25 state fee, so check the enrolment in your account. You can cancel anytime through the online account; no cancellation fee. Purchases become non-refundable after 90 days. Read the Northwest review.30, 31, 32, 33, 34

Rocket Lawyer

Rocket Lawyer sells the agent at $125 with a Plus or Pro membership, and the membership is billed on its own: Plus at $249/year, Pro at $349/year. Report filing is $100 with Pro membership, excluding state fees. Count the membership and the agent together when comparing. Cancel by phone, before renewal date; refund requests must arrive within 30 days of purchase. Read the Rocket Lawyer review.35, 36, 37, 38

InCorp Services

InCorp lists $129/year and a renewal of $129 per year flat rate (ToS: 'then current' fee). Legal documents are scanned and delivered same day. Stopping payment needs one of its listed conditions before the yearly fee is due: dissolve entity, appoint new agent, or resign InCorp with fees. Report filing is $89 + state fees. Refunds are requested within 60 days of issuance of services. Read the InCorp review.39, 40, 41, 42

Harbor Compliance

Harbor Compliance opens at $99 first year (new customers) and renews at $159 annually. It advertises "Same-day document scanning." The notice rule is strict: you must tell Harbor at least 90 days before the end of the current term, or a new term begins. Its managed report service is $199 per state per year plus filing fees, and its terms make all fees non-refundable. Read the Harbor Compliance review.43, 44, 45

Which of our best-for lists fit a West Virginia LLC?

The compliance list is the closest match, because a West Virginia LLC files an annual report and some services file it for you as part of a plan.

That list puts providers that file the report inside a plan first; Tailor Brands' Essential plan, for one, includes annual report filing. The agents with compliance tools page shows the rest. The cheapest agent services list orders by starting price, which puts Harbor Compliance first because of its discounted opening year for new customers. Founders who live abroad can check agents for non-resident founders, and new owners agents for first-time founders.

What does an agent cost a West Virginia LLC in the first year and after?

The first year is the state's $100 for the Articles of Organization, plus a $1.00 online processing fee when you file online, plus whatever the agent charges for its first year. From the second year, add the $25 report to the agent's renewal.3, 46

Where the first-year and later prices split, it happens differently at each provider.

An owner who names no agent pays none of these. If you weigh that route, read the guide first. An LLC formed in another state pays $150 (Certificate of Authority) to register here instead of the formation fee. West Virginia agent services: common questions

Does a West Virginia LLC have to hire an agent for service of process?

No. The state's position is that West Virginia LLCs are not required to appoint an agent for service of process, and the Articles mark the agent line "if any." Lacking an agent is not a ground for dissolution. The facts we cite don't say how papers reach an LLC with no agent, so ask the West Virginia Secretary of State or a lawyer before skipping it.1

How much does it cost to switch agents in West Virginia?

The state fee is $15, filed on Form AAO, and the state allows online filing via the One Stop portal. The bigger cost can sit in the old provider's terms, such as Harbor Compliance's notice at least 90 days before the end of the current term. File the new appointment before cancelling.6, 7, 44

Is a paid annual report service worth it for a West Virginia LLC?

That depends on how you value the time saved. The state's fee is $25 if filed between January 1 and June 30 of each year, while services charge their own fee on top, such as ZenBusiness's Annual Report Filing $100 per report. Missing the window brings a $50 late fee if received after June 30 (total $75), and failing to file within 60 days after due is a ground for administrative dissolution. Staying compliant in West Virginia covers the report in full.3, 5, 13

What happens if my West Virginia agent resigns?

The agent files a statement of resignation, the SOS mails copies to the LLC, and the agency ends on the 31st day after filing. You can then name a replacement or leave the line empty, since the agent is optional. Read how to cancel an agent for service of process before you stop paying any service.48

Can I use the agent's address as my business address?

Check the provider's terms first. Tailor Brands says "Agent address cannot be used as the business location in public materials," and Bizee sells a separate business address at $29/month. Every hired agent puts its address in the agent line; the designated office line is separate. What an agent can and can't keep off the record explains what stays public.10, 22

How is the list on this page ordered?

By our score, highest first, with ties in editorial order. The largest share of the score comes from each company's Trustpilot rating, which covers the company as a whole and not its West Virginia work. The method is on how we score.
