Best LLC formation services in New Mexico

Facts checked October 13 to 14, 2026.

A New Mexico LLC is formed by filing with the New Mexico Secretary of State through the SOS Business Portal (enterprise.sos.nm.gov); as the office puts it, "All business filings have moved to online process." You also name a registered agent who meets NMSA 1978 § 53-19-5. We couldn't verify the state's filing fee or standard processing time from a page we can cite, so confirm both with the Secretary of State before you file. A formation service files the same document for you, with its package price on top of the state fee. Packages differ mainly in whether they include an agent, an EIN, an operating agreement and faster handling.1, 2

What are the steps to form an LLC in New Mexico?

Pick a name, choose a registered agent, file online in the Secretary of State's portal, then get an EIN, sign an operating agreement and decide how the LLC will be taxed.

The order below settles the name and the agent before anything is filed.

  1. Search the name. Check the Secretary of State's records for a name that is free before you file. We couldn't verify whether New Mexico offers a paid name reservation or what it costs, so don't plan around one.
  2. Choose the registered agent. The agent must be an individual resident of New Mexico, a domestic corporation, LLC or partnership having a place of business in New Mexico, or an out-of-state company authorized here with a place of business at the registered office. The LLC needs a registered office that may be the same as the limited liability company's principal place of business. A New Mexico resident can be the agent, which saves the service fee; the New Mexico registered agent guide explains who qualifies.2
  3. Open the portal. The Secretary of State says "We will no longer accept paper filings for any business applications," so there is no paper form to print and post. A service files online on your behalf.1
  4. Complete and submit the formation filing. You give the LLC's name and its registered agent and office, plus whatever else the portal asks for, and pay the state fee. Walk-in help is limited too, since the office is closed to in-person, walk-in Business Services customers on Fridays.1
  5. Wait for approval. We couldn't verify a standard state processing time or a state expedite option. Speeds that services advertise often describe their own handling; ZenBusiness, for one, says its time excludes Secretary of State time.3
  6. Get an EIN. The IRS issues the Employer Identification Number, the LLC's federal tax ID; the state doesn't. Banks usually ask for it, and several packages below file the application for you.
  7. Sign an operating agreement. This private document sets out who owns what, who makes decisions and what happens when an owner leaves.
  8. Decide on tax status. New Mexico's $50 annual franchise tax applies only if the LLC is taxed as a corporation for federal purposes, and it is reported on form CIT-1, Corporate Income and Franchise Tax Return. An LLC that keeps its default federal tax status falls outside that rule as the tax department describes it, though its page doesn't speak to those LLCs directly.4
  9. Keep the agent in place. An LLC that fails for 30 days to appoint and maintain a registered agent gives the state grounds for administrative revocation. What else is due after formation is on staying compliant in New Mexico.5

What does a New Mexico LLC cost with a service and without one?

The state's formation fee is the same whether you file or a service does, and every provider adds it on top of its own price. We couldn't confirm that fee from a citable official page, so it isn't shown here.

"Not listed" means the package description we checked doesn't mention the item, so ask the provider before you pay. The first-year and later-year arithmetic, with agent renewals, is on the cheapest ways to form a New Mexico LLC.

What does each formation package include, and what does it leave out?

These paragraphs cover only each provider's published formation terms, in the order of the provider table: our score, highest first, ties in editorial order (how we score).

The package facts we hold aren't specific to New Mexico. A provider that will also be your agent still has to meet the statute's test. The agent services themselves are compared in New Mexico registered agents compared.

Tailor Brands

Lite is $0 plus state fees, with processing listed as within 14 business days; it comes with a bookkeeping 30-day free trial, business coaching platform, sales and payments, and its description says no annual compliance, operating agreement or branding tools. Essential, $199/yr plus state fees, cuts handling to within 1 business day and adds annual compliance (report filing and updates), operating agreement and a funding search. Whether New Mexico has a recurring report for that compliance feature to file isn't among the facts we could verify from an official page. The packages don't list a registered agent; the agent is priced at $199/year. Essential and Elite are yearly charges, and Elite is $249/yr plus state fees.6, 7

ZenBusiness

Starter costs $0 + state fees (does not renew) and covers initial state filing, standard 7-10 day processing. ZenBusiness says its timing excludes Secretary of State time, so the state's review adds to it, and the faster option is a Rush upgrade +$79 on Starter. Starter also includes Worry-Free Compliance free for 1 year (then $199/yr), a renewal date to note. Pro costs $199 + state fees, renews at $199/yr, and its list includes an EIN, operating agreement template. The agent isn't part of any plan and is sold as an add-on +$199/yr, though new LLCs can get 50% off the first year ($99) when you form an LLC.3, 29

LegalZoom

LegalZoom's Basic package, $0 + state filing fees, files the Articles of organization, and its list also has a Name check service, to confirm that your preferred business name is available. The EIN costs $79, and an operating agreement starts at $99. The middle tier, $249 + state filing fees, adds attorney consultations (30 days included, then $49/month auto-renew), and its EIN filing for founders without an SSN is included in Pro and Premium. The top tier, $299 + state filing fees, adds bookkeeping tools, 6-month subscription included.10, 12, 30

Bizee

Bizee's Basic package, $0 + state fee, includes the agent for the first year, after which it renews at $149/year (ongoing annual fee). The EIN ($70) and operating agreement (+$99) are extras. Standard, $199 + state fee, adds the EIN, the operating agreement and faster processing (~2 weeks), and Premium, $299 + state fee, lists expedited filing (~4 business days). Those timings are Bizee's descriptions, and the facts we hold don't say how they relate to the Secretary of State's own review.14, 15, 31

Swyft Filings

Swyft's Basic package, $0 + state fees, prepares and files the formation document, with processing in 7-10 business days. Standard is $169 + state fees (promotional, 'SAVE $30'; regular $199) and adds custom organizational minutes, custom banking resolution, business banking essentials, operating agreement, while no package lists a registered agent, which Swyft sells separately at $149 per quarter ($596/year). Every plan includes a trial of ComplianceGuard $199/year on these terms: 14-day free trial then auto-charged. If you don't want it, the trial has to be cancelled before it ends.16, 32, 33

doola

doola's Starter plan costs $297/yr and recurs each year. It lists LLC filing, EIN, US bank account guidance, US business address, registered agent, though doola doesn't say how long the agent stays included. It says it files within 1-2 business days, and the state's review follows. Founders based outside the U.S. can compare it with others on agents for non-resident founders.17, 18

Northwest Registered Agent

Northwest's formation is $39 + State Fees and bundles a free domain name, open source website, phone line, business email, business address, brand protection. Only its corporation page describes the formation price as a total that includes one year of registered agent service, so ask whether an LLC order includes the agent. The EIN costs $50 (with SSN) or $200 without SSN. Its operating agreement is offered as a Free template. Bought alone, the agent is $125 per year.19, 20, 21, 22, 34

Rocket Lawyer

Rocket Lawyer ties formation to its membership (First registration free with a Rocket Lawyer membership), and each membership is billed yearly after a free 7-day trial. Standard is $149/year, Plus $249/year and Pro $349/year. The agent costs $125 with a Plus or Pro membership, so Standard members can't add it. The EIN is $70 with Plus or Pro membership.23, 24, 35, 36

InCorp

InCorp prices formation starting at $99 plus state fees, and the only inclusion we could verify is live chat and phone support. The agent is sold separately at $129 per state per year. Its rush option is a $50.00 InCorp expedite fee (state expedite fee extra); we couldn't verify whether New Mexico offers a state expedite or what it costs. EIN filing costs extra (EIN service, $69).25, 26, 27, 37

Harbor Compliance

Harbor's formation price reads "Starting at $99 plus state fees." It says it can prepare and file the government forms to create most LLCs in one business day, and that state response varies. Its formation page names a registered agent, EIN, operating agreement among the items it handles without saying which tier includes them. It says it can expedite the state's processing of your LLC in most states, with the price not published. If Harbor becomes your agent, the agent service renews unless notice of non-renewal arrives at least 90 days before the end of the current term.28, 38, 39

Is it better to file a New Mexico LLC yourself or pay a service?

Filing yourself means paying the state fee with no package price, and the portal takes the whole filing online. A service saves you the data entry and can bundle the agent, EIN and operating agreement.

With no paper filings accepted, there are no forms to mail and no postal delays to manage. You still need a qualifying agent. A New Mexico resident owner can take that role, though the address given then appears in the agent field of the public filing, and that person needs to be reachable there.

A service makes more sense when no owner lives in New Mexico, because a person serving as agent must be an individual resident of New Mexico. It also helps when you want the EIN and operating agreement handled in one checkout.

Watch the recurring parts of any package. Several plans bill every year, and some bundle a free first period of an agent or compliance service that renews at full price, such as ZenBusiness's Worry-Free Compliance free for 1 year (then $199/yr). Owners with partners or outside money may want a lawyer to draft the operating agreement rather than relying on a template. The glossary defines the filing terms used here.

New Mexico LLC formation questions

Can I file New Mexico LLC paperwork by mail?

No. The Secretary of State says "We will no longer accept paper filings for any business applications," and filings go through the SOS Business Portal (enterprise.sos.nm.gov). A service files online the same way.

How long does New Mexico take to approve an LLC?

We couldn't verify a standard processing time from the Secretary of State's pages. Provider timings, such as ZenBusiness's note that its time excludes Secretary of State time, describe the provider's own handling, not the state's review.

Do I need a New Mexico address to form an LLC there?

The LLC needs a registered office that may be the same as the limited liability company's principal place of business, and its agent must be a New Mexico resident or an entity with a qualifying place of business. The facts we verified set those rules for the agent and registered office, and none of them asks owners to live in the state. A commercial agent can fill the agent field.2

Is there a yearly state tax on a New Mexico LLC?

The $50 annual franchise tax applies only if the LLC is taxed as a corporation for federal purposes. The tax department's page doesn't address LLCs taxed as partnerships or disregarded entities, so check your federal tax status with an accountant. Other recurring duties are on staying compliant in New Mexico.4

Which formation packages include a New Mexico registered agent?

Bizee's packages include the agent for the first year, and doola's Starter includes one without saying for how long. ZenBusiness sells it as an add-on +$199/yr, InCorp has it sold separately at $129 per state per year, and Swyft Filings sells it outside its packages. Check the renewal price as well as the first year, which the agent comparison for New Mexico lists.14

Does a service's rush option speed up the state?

Not always. InCorp's rush is a $50.00 InCorp expedite fee (state expedite fee extra), which covers its own handling, while Harbor Compliance says it can expedite the state's processing of your LLC in most states. We couldn't verify whether New Mexico offers its own expedite option, so ask the provider what its rush buys.37
