Cheapest LLC formation in New Mexico

Facts checked October 13 to 14, 2026.

Going by the costs we could verify, the floor for a New Mexico LLC is the Secretary of State's filing fee alone, if an owner who lives in the state acts as registered agent or a package such as Bizee's ($0 + state fee) covers the agent's first year. We couldn't verify that filing fee from an official page we can cite, so check it with the Secretary of State before you file. From the second year, the agent's renewal recurs unless an owner acts as agent, and the only recurring state charge we could verify, the $50 annual franchise tax, applies only to an LLC taxed as a corporation. A "free" formation package still means the state fee on day one and an agent renewal later, such as Bizee's $149/year (ongoing annual fee).1, 2, 3

Which New Mexico costs are set by the state?

The state charges we can describe are the formation filing fee, which every new LLC pays, and a yearly franchise tax that only reaches LLCs taxed as corporations. No provider can discount either one.

The formation fee is paid online, because, in the office's words, "All business filings have moved to online process." Its business page adds: "We will no longer accept paper filings for any business applications." We couldn't verify the fee itself from an official page, so this page leaves the number out rather than guess.4

The other state cost depends on a tax choice you make, not on where you file. New Mexico's $50 annual franchise tax applies only if the LLC is taxed as a corporation for federal purposes, reported on form CIT-1. An LLC that keeps its default federal treatment falls outside the rule as the tax department describes it, though that page doesn't speak to partnership or single-owner LLCs directly. If you plan to elect corporate taxation, add this tax to every year's budget.2

We couldn't confirm from an official page whether New Mexico charges LLCs a recurring report fee, a name reservation fee or a fee to change agents. The New Mexico compliance page tracks what is verified about ongoing filings.

What pushes the cost of a New Mexico LLC up?

The costs that vary are the registered agent, package upgrades, add-ons sold at checkout and subscriptions that start free. Each one is a choice you can make before you pay.

The registered agent

Every New Mexico LLC needs an agent under NMSA 1978 § 53-19-5. The free route is an owner or friend who is an individual resident of New Mexico. The statute separately requires a registered office that may be the same as the limited liability company's principal place of business. That person's name and address then go in the agent field of the public record, and someone must be there to receive legal papers.5

A paid agent is a recurring bill. Packages that bundle the first year make the second year the first real charge. If you later switch to a cheaper agent, the change goes into the portal before the old service is cancelled. It is grounds for administrative revocation when an LLC fails for 30 days to appoint and maintain a registered agent, and we couldn't verify how reinstatement works or what it costs. The steps to change a registered agent show the safe order.6

Faster handling

We couldn't verify a state expedite option for New Mexico. Some providers sell faster handling on their side: ZenBusiness offers a Rush upgrade +$79 on Starter, and InCorp charges a $50.00 InCorp expedite fee. Unless you have a deadline, such as a lease that needs the LLC to exist, standard handling costs nothing extra.7, 8

Add-ons and subscriptions

Checkout pages commonly offer an EIN, an operating agreement, a business address and a compliance plan, each priced on its own. ZenBusiness sells the EIN at $99 one-time (included in Pro and Premium) and its operating agreement at $99 one-time template (included in Pro and Premium). Swyft Filings, for its part, sells a business address at $29/mo. Some offers start free and then bill: ZenBusiness's Starter includes Worry-Free Compliance free for 1 year (then $199/yr), and Swyft says that once its free ComplianceGuard trial ends, your card will automatically be charged $199 for a one-year subscription. Mark each renewal date when you order.7, 9, 10, 11

Below, each provider's cheapest route in its first year and what it costs to keep, in the same order.

Tailor Brands. Lite is $0 plus state fees and doesn't list an agent, so add $199/year or use a resident owner. Moving up to Essential means $199/yr plus state fees, charged every year. See the Tailor Brands review.12, 13

ZenBusiness. Starter is $0 + state fees (does not renew), and the agent is an add-on +$199/yr. New LLCs can get 50% off the first year ($99) when you form an LLC, then the agent renews at $199/yr. See the ZenBusiness review.7, 14

LegalZoom. Basic is $0 + state filing fees. The agent is $249/year (first-time registered agent customers), and the renewal follows the purchase rate, with the rate subject to change. On the next package, attorney access switches to $49/month auto-renew once the included period ends. See the LegalZoom review.15, 16

Bizee. Basic is $0 + state fee with a free first year with any Bizee formation package. That leaves the state fee as the first-year cost and $149/year (ongoing annual fee) as the agent's cost after that. See the Bizee review.17

Swyft Filings. Basic is $0 + state fees, with no agent listed. Swyft's agent works out to $596/year, the highest yearly agent price here, so a resident owner as agent saves the most with this provider. See the Swyft Filings review.10, 18

doola. Starter includes the agent but costs $297/yr, so the full plan price returns each year rather than an agent renewal alone. See the doola review.19

Northwest Registered Agent. Formation is $39 + State Fees. Only its corporation page describes the formation price as a total that includes one year of registered agent service, so ask whether an LLC order includes the agent before you count on it; bought alone, the agent is $125 per year. See the Northwest review.20, 21, 22

Rocket Lawyer. Formation comes with a membership, billed yearly. Standard costs $149/year and leaves the agent out. To add the agent ($125 with a Plus or Pro membership) you need Plus at $249/year or Pro at $349/year. See the Rocket Lawyer review.23, 24

InCorp Services. Formation is priced starting at $99 plus state fees, with the registered agent sold separately at $129 per state per year. Its terms allow renewal at the 'then current' fee. See the InCorp review.25, 26, 27

Harbor Compliance. Formation starts at $99 plus state fees. The agent comes with a discounted first year at $99 for new customers (regular $159), and stopping the renewal takes notice at least 90 days before the end of the current term. See the Harbor Compliance review.28, 29, 30

New Mexico LLC cost questions

Can a New Mexico LLC cost only the state fee?

Going by the costs we could verify, yes, in its first year, if the agent costs you nothing. That means an owner who is an individual resident of New Mexico acts as agent, or a package like Bizee's ($0 + state fee) includes the agent's first year. After that, a bundled agent renews at the provider's yearly price.

What does a New Mexico LLC cost each year after formation?

The agent's renewal, if you pay for one, plus any yearly package or subscription you chose. The $50 annual franchise tax applies only when the LLC elects corporate taxation. We couldn't confirm from an official page whether a recurring state report fee applies; see staying compliant in New Mexico.

Is it cheaper to be my own registered agent in New Mexico?

It removes the agent fee, but under NMSA 1978 § 53-19-5 a person serving as agent must be an individual resident of New Mexico, and an entity needs a qualifying place of business. Your name and address then sit in the agent field of the public record. The New Mexico registered agent guide covers who qualifies.

What does it cost if my agent resigns or I stop paying?

A resigning agent's appointment ends 30 days after the notice is received, unless a successor is named first. It is grounds for administrative revocation when an LLC fails for 30 days to appoint and maintain a registered agent, and we couldn't verify what reinstatement costs. Naming a new agent in the portal before the old one leaves avoids the gap.
